This session considers the family farm/business exemptions available in various states, including:
- Where is the family farm? Understanding the primary production test
- What types of transactions are covered?
- Restructuring assets out of family trust
- What is the nature of the link required between the transferor and the transferee?
- What relatives are covered – for example, cousins and uncles/aunties?
- Are non-natural persons covered – for example, transfer to or from trusts?
- Is it permissible to transfer from taxpayer to taxpayer and other persons?
- When is consideration being provided?
- Is a UPE being eliminated?
