  • The legal definition of a trust in Australian law
  • The types of trusts and any peculiarity arising from the type of trust which may impact on conveyancing transactions (including bare and superannuation trusts)
  • The officeholders of a trust (e.g. settlor, trustee, beneficiaries and what role they each play)
  • Tax issues which may arise from the involvement of a trust or trustee in a property transaction
  • Steps conveyancers should take to ascertain the existence of trusts and verification of identity for officeholders and potential beneficiaries
