About the Webinar

The transfer of business ownership from one generation to the next can be an extremely complex task. So, with the small business CGT (SBCGT) concessions on hand to provide such generous tax outcomes for the right situation, how can those concessions be utilized to assist with the intergenerational transfer? This session investigates the topic, including:

  • How the SBCGT concessions can be applied to:
    • the transfer of shares in a company or units in a trust to the next generation
    • the transfer of business assets to a new entity
  • How the “market value substitution” rule can be utilized by the SBCGT concessions to provide a CGT cost base uplift
  • Can the SBCGT concessions be a benefit for a family business conducted in a discretionary trust that is looking at generational change?
  • Can change of business ownership affect future SBCGT concessions for business premises continued to be held in a separate family entity?
  • The pros and cons of utilising the SBCGT concessions for the transfer of business ownership to the next generation
  • Tips for planning for eligibility and use of the SBCGT concessions when generational transfer is on the horizon
  • An intergenerational dairy farm whose owner was crying over spilt milk when his SBCGT concession eligibility went down the drain (VSVS v FCT (Taxation and Business) [2024] ARTA 249)
  • Case study
