About the Webinar

Until recently, there was uncertainty as to whether CTP insurers should be treated as a State and whether the Personal Injury Commission (PIC) had jurisdiction to determine those matters. Recently, this issue was finally clarified. This has had, and will continue to have, a significant impact on the hundreds of PIC applications which had been either dismissed, referred or rejected by the PIC prior to the decision. This session will discuss:

  • The recent important decisions which led to this change including:
      • Ritchie v Nominal Defendant (Judge Gibb NSWDC 5 November 2021, unpublished),
      • Stanton v Winning [2022] NSWDC 104
      • Condon v Bartley and Ward v QBE NSWDC [2022];
      • Islam v Transport Accident Commission of Victoria Worldon v Transport Accident Commission of Victoria [2022] NSWDC 582
      • Searle v McGregor [2022] NSWCA 213
  • How the PIC is responding.
  • What options are available for applicants who have had their matter dismissed, referred or rejected prior to these decisions.
  • What is an exercise of federal jurisdiction and what is an exercise of administrative power? Is there a difference?
  • What does it all mean for future applications in this space?
